There are laws, but when enforcing these laws, a lot of common sense and sense of feasibility is applied. Too hot, low wages, long hours, need to rest - no need to collect FMM, let them tourists go. No TIPs in Baja, hence no need to keep a booth for collecting FMM in Tijuana and Otay, since FMM is a document of lesser importance than TIP.
