To answer the OP...if your life, or the life of your family, wwere actually in danger, the bear was attacking, not just stealing your grub, I would guess that you'd get away with it. But...the question would then be asked...what were you doing with your gun in your hands instead of stored. So..I'd say, leave it behind.
Just like some laws in the US, or any other country, our gun laws are fiercly enforced.
Having said that...were I you? I'd call an official office and ask the question. And NOT Banff...call somewhere in Ontario and use THAT location as the query point.
