It is called DUI - driving under the influence. It does not just cover alcohol and hasn't in a long time. This covers alcohol, legal and illegal drugs as well as any type of inhalant (glue, paint, etc.)
The tolerance for alcohol in MOST states is .08, but if you are exhibiting signs of drunkenness and you register a .05, you can still be charged and convicted of DUI.
The laws are already in place to cover the use and abuse of marijuana as well as other drugs. i.e. If you are prescribed Valium and use it, but also drive a car and you appear and act impaired, you can be charged with DUI.
I am a retired LEO and as stated in my reply above, I would much rather have someone smoking weed camping beside me and my children (9 and 6) than a drunk!! Anyday.
