Whether they are a "tote" or a "trailer" will depend on the DMV of the individual state. Some states consider anything attached that wasn't part of the original trailer as a trailer. FWIW I've pulled that through, and stayed in, several states, including Virginia, that don't allow double towing and never have had an issue. YMMV. I always considered it a trailer and had it licensed.
