I've seen lots of debate over this issue. I've even seen a manufacturer (can't remember which) state that it doesn't qualify as a trailer but they never showed official documentation.
Because it is pinned at two points and cannot pivot relative to the main trailer, it functions as part of the main trailer. Will that hold up when the officer pulls out his book of tickets...?
But as someone else said, there aren't a lot of stories about people getting pulled over with these attachements.
