But they have to have the evidence that one was overloaded.
If the vehicles involved were (a) totaled, then they were hauled away to junkyards/temp storage.
If they were not totaled, and both parties could "drive away", then they do so, and no one is there to weigh them before they depart.
I agree a lawyer could try to use that info, but I have yet to hear of any case where it was used, and the result was the RVer was found guilty.
Hell, I'd bet some smartass lawyer could try to say "this guy was driving with china bomb's, and you can read all over the inter-web how those things self destruct when they reach 66MPH, so CLEARLY, the blow-out he had caused the wreck, and he did it intentionally".
There's a shitpot full of what if's in today's world that can happen. The question is, can anyone point to any definitive evidence that shows weight factors were used in a civil case and the result was an award?
