If it's surface rust the dealer should take care of it.  A little sanding, a good primer with rust inhibitor and a couple coats of paint and you'll be good for about 10 years.  Surface rust is mostly a cosmetic problem.
If the rust has eaten holes in the frame, that's another story. A replacement would be warranted.
You need to send a registered letter with signature receipt. Send a letter to each of the executives and one to the general manager of La Mesa. Include photos. The letters will give you a paper trail in case you decide to go to court. Be sure to write down everything you are told with dates and times for each contact.
