South Dakota State Income Tax

I must admit I haven't done any research on this subject/question but I decided to throw it out there to get an answer. We are in our first year of full timeing and South Dakota is our residence. SD does not have state income tax so it appears one does not have anything to file for income tax with SD. Is my thinking correct? Thanks for any input and thoughts.

    :h

I live in a no-income-tax-state, too...why on earth would one have to file an "income tax return" if no such tax could possibly be due???

But just in case South Dakota has some wacky other ideas, here's a link to all possible tax filing forms for that State:check 'em out!
  • Easy to just give an example. I worked and retired in CA. I sold all my holdings in CA. I have no present income from CA except retirement. I moved to WY. WY does not have a state income tax. I do not have to pay any state income tax to CA. That was a federal law that was passed in the 90s.
  • Thanks folks for the quick response. I retired in April 2013 in South Carolina, which I will have to probably pay some tax. We became South Dakota residence in May 2013. Since retirement we have been full timing living off retirement annuity and social security. Life has been good so far. We just completed a 13,000 mile trip up the east coast and into Canada and back to South Carolina. Next year plan is to go out west. Take care and thanks again for your input.

    I think I could handle that....:W......Dennis

Tax software like Turbo-Tax and the others won't let you file a 'state' return if you state is SD, or Texas or Florida or other states without a state income tax.

However, in many cases you will have to file a state income tax return for a state in which you earned money.

If you were employed and earned money in a state with an income tax before going full-time and changing your residence in 2013, you will almost certainly have to file in that state.

If you workcamped in states which have a state income tax, you might have to file in those states also.

I know one fulltimer who had to file four state income tax returns for 2012 - and his home and legal residence are in Texas.

  • If your legal residence is SD, then yes, your thinking is correct. I said 'legal' because I don't know what the actual definition of 'residence' is. Kinda sounds like you chose SD as your residence for fulltiming.
