I'd still take it higher, maybe even as high as the state insurance commissioner, being as known of an issue as it is I wouldn't expect great results.
The bigger issue here, IMO, is poor workmanship on the manufacturers part. As noted before, you don't have to look very hard or very long to find example after example of this very issue. Maybe it would be better advice to stay away from the builder, rather than the insurance company.
If the insurance was not going to cover something like what happened, they should have it in black and white. We buy insurance for protection against anything mother nature throws at us or collisions.
But these insurance claim adjusters are trained to be as conservative on their claims as possible, and if they get away with it every once in awhile, they will keep on doing it. You have to push or they will run all over you.
