It varies state by state. In Florida, they can only charge the rate based on actual usage. but, go one state north to Georgia and they can also add to your meter rate the amount the entire complex uses for common area. And there are states that don't allow any upcharges to the meter rates but they let the complex set the meter rates which could be more than the utility charges.
