I believe that the law here in Washington is that you need a braking system if your towed vehicle is over 3000# AND a break-away system is required. Only nine states don't require them, but do have some kind of requirement for being able to stop safely.
I still can't see how that could have happened if the base plates had been installed correctly. I do know that every time I park my MH anywhere and leave it, I recheck the tow set-up to make sure that it's ok. The reason for that is that one of the very first times we went out, we stopped in a parking lot to do some shopping and when we came out, the guy next to me said that there had been some older kids around our rigs when they came back and I'd better take a look at my tow bar. I checked it and they had pulled the pins and put a piece of wood in their place. They had also disconnected the safety cables and hung them to make it look as if they were still connected also. I did have an extra set of pins and went over to the nearby Home Depot and got keyed alike padlocks to put in place of the locking pins.
Yes, the other guy called 911. And yes, the police did catch them hanging around to see what happened and yes, one of them still had my pins in his jacket pocket. And no, it wasn't at a Wal-Mart.
Here is a synopsis of the WA State towing laws:

Note that under "Brake Laws Towed Cars" it says "No Laws regarding".
However, here is the WA State Braking Performance Law:

You must, of course, be capable of complying with this performance standard.
