I don't really understand the fear surrounding it. A jeep being towed will be at least as stable as just the jeep towing the boat on its own. Maybe even more stable because the effective wheelbase of the toad is ball-to-rear axle. And lots of motorhome drivers feel pulling a toad dampens side forces like wind gusts, and makes the MH drive even better.
Really, as long as the tow bar is rated for the total weight behind it, and a braking system is being used, the biggest hazard is probably other drivers not expecting a trailer behind the jeep and cutting lanes too soon.
I cut and pasted directly from the California Vehicle Code without editing, and section 465 clearly says a Housecar is a passenger vehicle.
