If the merchant determines the dog is NOT a service dog, does not allow entry, and it really is a service dog, he has much to lose. The lawyers will have a field day with him.
Very True, however there are other tests that must be met. The dog must be under constant control and restraint unless the person requiring assistance is unable to provide that restraint at which time the animal my be under voice command. If the animal exhibits lack of control the business may require the animal be removed (not the person requiring the animal). The animals are also not allowed in areas where they would an obvious health or safety issue (i.e. in certain medical situations, where food is being prepared etc.) The one I can't wait for is when the immovable object meets the irresistible force, a service dog crosses paths with a person who has severe allergies or certified animal phobia. Wonder how the business will handle that one should the service being provided require them both to be in the same space.
