They are severely limited by federal law.
They can only ask only:
Do you have a disability? No other follow up questions allowed.
Is that a service dog? No other follow up questions allowed.
How does the dog assist you? No other follow up questions allowed.
If the merchant determines the dog is NOT a service dog, does not allow entry, and it really is a service dog, he has much to lose. The lawyers will have a field day with him.
Here is an example of how a city is dealing with the false service dog issue.
Pit bull ban leads to service dog claims in Yakima
YAKIMA, Wash. (AP) — City officials in Yakima, Washington, say that some pit bull owners are falsely claiming that their dogs are service animal to circumvent a city ban of the breed.
City code manager Joe Caruso tells KIMA one pit bull whose owner claimed it was a service dog killed a cat that entered its yard, and another pit bull escaped and bit three people.
The dog that attacked people was put down and the cat killer is banned from the city until its case is heard in court.
Meanwhile, Yakima plans to ask service dog owners to sign a form that says they could be charged with perjury if their pit bull isn't a real service animal.
