An open wifi connection is just that, OPEN! There are no laws against using these signals for legitimate purposes.
Although the laws on this vary by State there are definite laws on the subject and there have been prosecutions. It is a bit of a stretch to say that open connections are free for use. If, for example, the wifi provider clearly states that wifi is provided for customer use then those amount to "terms of service" and people have been prosecuted for violating them.
