problem getting files of HDD

There is nothing to indicate that you ever created a backup. Your post specifically states that you are trying to recover directly from the old HDD. That is not a backup. That is a recovery model that can be unreliable and pain-filled in newer versions of Windows.
Windows has a number of "security features" that now make this relatively simple operation quite aggravating. Are you familiar with the built-in Windows backup program? It's called "Backup and Restore" or some such. I'm (fairly) certain that it's still in the PC versions of Windows up through 7.
I do have a back up HDD with my files,
Like I said, I always have backup, but since the original HDD was still in the case, I am using that to put the files on the new drive. It has all been fixed by changing permissions.
