The courts made the right decision. Its sad that the subdivision mafias due this. We looked at homes in several sub divisions but after reading all of their restrictions we could not picture ourselves being cookie cutter residensts. Our five acres in the county is perfect and I can look out my back door and see my fiver.

It is a very narrow decision. It does nothing to overturn any HOA or other parking regulations regarding RVs. The ruling actually just affirmed that a Judge's ruling that the family in question had special health needs that made the RV a necessity and therefore a variance should be granted to the codes was within the power and discretion of that judge. What happened is a judge granted a variance. An appeals court said that was overstepping the judges authority and the Supreme court of Louisiana overturned the appeals court and said that the variance was within the judge's legal authority. It was actually not a ruling on HOAs and parking regulations, it was a ruling as to what a judge can and cannot legally decide.

I thought you were given the rules in writing and signed to acknowledge those rules before you bought into an HOA. I dont see how anyone can complain about what they themselves agreed to. I may just not understand it though.

IMHO it was a bogus decision.When you sign up to live in a HOA you agree to abide by their rules. The rules that everybody agrees on. (That is why I would never live in an HOA controlled area.)If they can't abide by the rule they agreed upon they need to move to a place where there are no such rules.This is just another take on the old move next to an airport and then complain about the airplane noise IMHO. :S

Besides my fiver, I could see 4 single wide mobile homes from my property. No codes so each had 4 cars (1 ran and the other 3 were on jacks). There are trade-offs to everything.

They knew the rules when they bought the house.

Although I feel sorry for the son, that RV was purchased for the parents convenience. Not every handicapped person with that condition needs a 35' RV.

Just typical for our country in this era. If you don't like the rules, just spend the money and some liberal judge will side with you.

Some of our members here are very uncompassionate people!

Love how you guys try and turn the story around to fit how you think they are lying. The way I read the story is the way it actually reads, not something I am twisting and turning to make them look bad!

And Yes it is very possible the guy is taking his son with him, knowing he has limited time with him!

Dodgeguy - you can throw the "uncompassionate" card away; it belongs in the trash heap along with the "race card". Most handicap people get along just fine with a modified van. Would you like me to send you a picture of a person with MS in a minivan with a lift?

I was sort of wondering that myself. why didn't the fella do the standard/normal thing and modify a conversion van for transport?
does he really take his son everyplace, malls, movies, etc. in a 35 ft RV?

Who are you guys to tell someone how they should live their life? Let them live it as they see fit! Odviously the state supreme court seen it that way!

And this is at the heart of the problem. Why should family A get to live their lives that way, but family B doesn't? If family B's daily vehicle was totaled in an accident, why can't they park their 35 foot RV in the driveway because they need it to get around? Who gets to decide the criteria as to whether your reason is OK or not?

And, there is still the issue of asking forgiveness versus asking permission.

Why shouldn't the guy next door to you get to raise pigs in his yard than if: "Let them live as they see fit".
