One more thing;
While your insurance company might not cover based on the language of the policy, (read it for yourself and know this to be fact) your insurance company does have the fudiciary responsibility to settle the claim with those who are responsible.

My question to you is; have you filed a claim with your company or just took their word and didn't bother? If not, then file a claim. Make them put in writing that it's not covered. Then go back to them and tell them it's their duty to collect from the party involved; the consignment lot. It is their obligation to get a settlement for their policy holder regardless of the actual coverage on the item that is listed on the policy.

Sometimes all it takes is a bill from your insurance company to the consignment lot to get them to acknowledge their responsibility. Ask your agent if he'll do that for you.

Remember; take no one's word on what they say they cover or don't cover. File the claim with both; your insurance company, your homeowners policy and the consignment lot. Then be sure to get in writing their assertion that they are not responsible to cover based on specific language. They need to prove to you that specifically you are not covered, or they need to be prepared to argue their case in front of a judge.

Sorry if this is repeated, but I'm not going to read 4 pages when the first page starts out with some negative posts.

So, I just want to point out that while your RV might not be insured by your company, the personal property inside the RV sure should be. If not them, then your homeowner's policy.

You might get 'creative' and find that you had enough valuables inside to equal the cost of the RV itself. (wink wink)

Ever stop and think that maybe there are a certain number of RV's that "disappear" from this guys lot. Maybe he has a "friend" and they split the proceeds.

Just because you never did it or never saw it doesn't mean that it doesn't exist.

I perfectly understand that no dealer WILLINGLY ACCEPTS liability for a missing consignment unit. That does not automatically mean that he won't BE legally liable if the owner pushes it.

The facts of each individual case are important.

It remains possible that the dealer actually disposed of the RV himself and claimed it was stolen. That happens with Bank Deposit Bags almost every day of the year......but in that case an investigation occurs and the guilty "night manager" usually is found out.

No, I am not trying to argue the point. Just stating facts. Facts learned from 40 years of operating dealerships in multiple states. I bought the insurance policies, paid the attorneys to defend me, went to national dealer organization seminars where the problem was discussed, and dealt with the situation many times.

There were cases over the years where minor items were stolen while in my care and I opted to pay for these items where the customer was valued to the point it was a good business decision. That never extended to accepting the responsibility for the theft of the entire unit.
