You make a good point. However, there are two issues to consider. The first, of course, is what deterrent is there to encourage others not to engage in the same behavior? Punishment serves not only for the perpetrator but to discourage potential perpetrators. Secondly, why would a dishonest man all of a sudden become honest and pay back the money? Not likely.
