"There are some extenuating circumstances, according to the driver's version of the incident. He said that he came around a curve and did not have time to get stopped or get over to a different lane."
There is absolutely nothing "extenuating" here. While it is easy for us to "Monday morning quarterback" his statement is damning. There is no excuse whatsoever for not being in complete control of your vehicle at all times(as required by law). Clearly, by his own admission, he was exceeding the safe speed (Basic speed law), for the conditions.
I can only hope this will serve as a lesson for others. Slow down folks, there is nowhere you "have" to be that is worth someone's life.
