When I use my B&W hitch the arm doesn't always snap closed completely, sometimes it's an inch or so from the stop. The jaws are locked solidly but a latch wouldn't work in such a scenario, and a heavier spring might make it harder to keep the jaws open, and this could lead to someone locking the arm open.

You simply cannot engineer something for every possible event. If the latch would make you feel better by all means gin one up, but mine works just fine without it.
