In Texas you can still be arrested in a car even if you're not driving it. My brother tied one on at 6th Street in Austin. Decided he was too drunk to drive & stopped at some place to sleep it off. Woke up to cop knocking on his window & was arrested & hauled off to jail because he was 'behind' the wheel of the car & could've conceivably just driven off drunk.

Yup I could see that happening.
I was not even drunk. I pulled off the road with my TT to catch a little sleep. I woke up to a cop pounding on my window!!!
Apparently I must have gotten cold and turned the key and started the car in my sleep. :R
Got read the riot act for sleeping with the car running.
Now when I pull off the road I throw the keys in the back seat.
I always pounded on windows to wake up a driver sleeping with the motor running. I did not want to have to deal with a dead body of someone that died from carbon monoxide poisoning in the morning
:B He made reference to that! He said he was getting off his shift and didn't have time to write up all the reports if I did! I 'was' very thankful for his actions.
