#1 Merging is an art, but you forgot your part. Slow down or speed up to let someone in. It's a merge lane, work together with those trying to merge. There is no stop at the end of the merge lane, they have to get in and you are expected to assist them with that.
Legally, you should hold a steady speed and let the merging vehicle pick a gap to take.
Nothing worse than trying to slide in behind someone while merging and they hit the brakes blocking you.
If they wind up running on the shoulder for a while because they weren't paying attention, that's their problem.
