Polygraph Testing??

I am applying for a position and this is in the agreement that they want me to sign.

"further agrees to random polygraph testing throughout the term of employment only as it may relate to items that could affect, influence, or subject the company to misappropriation, defalcation, inappropriate actions or the like."

Has anyone seen this before? I do not think I want to do this.

    This is basically a regurgitation of the federal Employee Polygraph Protection Act (EPPA). The request the employer is making may be inappropriate because random testing is not allowed. There are conditions that must be met before an employee can be tested, which would, by definition, make the testing not random. A few condtions are there must be a loss by the employer, the time and place of the testing must be given in advance (they can't just usher you into a room and wire you up), the employee must have access to the materials that were misappropriated, and the questioning must not be of personal nature.
    Whether or not I would accept the position based on the polygraph condition would depend upon the position. For a near minimum wage temp job, not interested. If I was in the running for the CEO of Apple, sign me up. In the real world, if something is stolen and you are potentially a suspect, you will probably be investigated, polygraph or not. A test might actually clear you name much quicker and be better than being under a cloud of suspicion that covers everyone.
  • Ask them if it's they agree that it would be alright for you to record the session and keep the recording.
