I am pretty sure the reason the fuel was dyed is that it was obviously cheaper, since it didn't have a road tax paid for it.
As for checks, I do know that CHP (California's state patrol) will stick diesel pickups. A former co-worker had this happen.
I asked about red dye and diesel about a year ago. Here in Texas, because the penalties are so high, even farms don't mess with the red stuff. They buy the road taxed diesel, and submit the receipts come tax time. It is a lot cheaper than a state audit of the entire operation, and having to deal with impounded vehicles.
