That's all very interesting, but the National Highway TrafficSafety Commission disagrees with (your interpretation of) the National Transportation Safety Board's report...probably because the the two agencies have very different responsibilities.
According to this NHTSA report, more or less concurrent with the NTSB report you mentioned earlier:
