When moving vehicle hits pedestrian, it is almost always the moving vehicle that is legally at fault. It is the driver's obligation to be sure the road is clear, not the obligation of everyone else to clear the road.
Glad to see the OP was able to put into his narrative that the father was holding a beer. Obviously that makes him an incompetent idiot. Perhaps to level the playing field the OP can tell us the make of truck he drives, that way the owners of the other two major manufacturers will automatically conclude he is an incompetent idiot as well. Then we will have what really happened, two incompetent idiots meeting on a one way bridge.
