It darn hard to imagine a bank employee getting fired for giving a customer back his non-stolen valid card. It's also hard to imagine a government regulation saying that any card confiscated during a malfunction of the ATM is considered stolen.
Then again, it's the federal gov't, so I guess it shouldn't be that big of a surprise.
