Yes it has been around for a long time. However until just recently if was not hidden in the fine print of the contract. In fact some CC companies have language in the contract that says if you use their card in any transaction, after the date they sent their "change notice" with your bill, you have automatically accepted "Binding Arbitration" as the method to deal with all disagreements. Said "Change notice" almost always starts out with verbiage about how they are going to protect you confidential information, (which we all know is garbage). Then they insert this "Binding Arbitration" clause in with the other means nothing language.
