Add the disclaimer at your own peril. It is an admission possibly leading to a contributory negligence claim. No disclaimer is legally safer What you are selling has a stated weight. What they have now or may get in the future has a stated max tow weight. Why would you voluntarily embroil yourself in possible future problems by including anything?
