I'm amazed. This same group that cries foul when a dealer says a vehicle can tow something when it can't is encouraging another forum member to do the same as the dealer. Unfathomable.
You have done your moral duty, actually above and beyond. The next move is theirs to make. I would sell it with a final warning about getting larger tow vehicle.
Above and beyond? Even more mindboggling. Are you suggesting he didn't have to say anything in the first place? "Moral duty" goes FAR beyond "I told you so". Isn't part of "moral duty" preventing an incident when one can in the first place? I guess that morals have VERY different meanings when money is involved.
I'd sell it. With, as others have said, as is, where is, no warranty expressed or implied.
This is about SAFETY not about a warranty. Say you sell a baby crib to someone that doesn't meet the new federal standards. You warn them but they buy it anyway and then the baby gets injured, or worse, dies because it gets it's head stuck between the slats. The crib didn't break but caused bodily harm ergo warranty vs. safety. VERY different. Would you want that on YOUR head?
