What was the prior agreed upon procedure? Did you agree to pay for X number of hours of labor before they started, even if the problem might not be corrected? There's no way I would pay that much money for a shop to work on a problem that wasn't actually fixed.
You brought the vehicle in to get the problem corrected. They couldn't do it, but still want to be paid, because they worked on it. The only way I would pay that bill is if it was plainly spelled out in advance that they got paid whether the problem was fixed or not.
Our local shop that we have do some work now and then tried to fix our Dodge truck's air conditioner. They put in a new condenser, which entails tearing the whole dash apart. Much, much work. It didn't fix the problem, but they tried a couple more things and had no luck. They gave it back to us unrepaired and charged us nothing. The other shop we took it to fixed the problem which was a bad condenser, the one the first shop put in was bad. They changed it out and problem solved. That shop we paid.
