Look under the hitch head and you should see a small hex head bolt.  That bolt needs to be tightend up against the shaft to hold the hitch head in position once you have the tilt adjusted where you want it.  That bolt needs to be checked every time you tow as it tends to loosen up quickly.  If it is tight then the hitch head is pinned into position and cannot pivot on that lower large bolt as yours is doing.
The large bolts DO need to be torqued properly and the small bolt under the head tightened.  Doing this will ensure that your hitch head will remain in postition as it is intended to be.
