Legally? What about ethically? What value do you place on your word? You committed to purchase, now you want to back out. I suspect you'd be very upset if the dealer called after you placed a deposit and told you the price would be $4000 more. How is this any different?
Sure, you can back out. But, don't expect to get your deposit back. That would be unreasonable and unethical.
