I've seen a few trailer-tow vehicle combinations where folks did not use WDH. I also had questions running through my head, and very tempted to talk to them, but never did. I have learned that some folks are just too stubborn to take advise and will bite you in the arse for even raising any questions about their abilities or experience or ANYTHING they are doing!
About government licensing? NO! We have too much government control over our lives the way it is. YOU and ME are doing it right! We don't need to charged extra fees for something like this..... besides ... what's going to happen when you turn 65 years old and finally retire and then find out the government has restricted you because of your age from towing anything. Sound ridiculous? Yes. But once you surrender your personal freedoms to allow the government to start establishing rules, it only gets more and more restrictive over time, and we never get the freedom back to self-determine our own choices.
Government licensing will serve no purpose. You will STILL have those people out there that will not comply anyway! It only limits and hurts the ones who are already following the rules!
