It has to do with taxes since red diesel has no sales tax applied to it. You can legally run it in a generator if you have the proper tax exempt registration like we do at the farm, but not as a general home owner.

Correct. You have to use it for farm use at least some of the time and/or for whatever reason we stated on our AP-197 dyed fuel registration form.
Texas Tax Exemptions for Agriculture
Keep in mind that Texas does not have an income tax so sales and land tax is mainly how it makes its money so rules around these taxes may differ from some of the other states. The tax on our fuel is not just used for roads and therefor it is not seen as just a "road tax" here as it is in other states.
