If his assumption is correct and its to fix factory issues, yeah, any re-flashes should be recall work done by dealer free. I've gone through a few of those on my Jeep, they have done it to fix some reliability issues.
13 years later? I don't understand why the manufacturer should provide this for free on a 13 year old vehicle with xxx,xxx miles on it?
Jeep's still doing it 10 years later for mine, sure there comes a point where they quit issuing TSBs for issues like that on a vehicle (non-safety issues), but shouldn't matter if its 15 years later, if there was a TSB that wasn't completed, you better believe I would be making them do it. It's not like it takes a dealer more than 20min to do a reflash anyways, and they get reimbursed for doing it in most cases by the mfg (GM, Chrysler, Ford, etc).
A TSB is only a road map for the dealer or shop to diagnose and fix a common issue. They are not free unless you are under warranty (they are not the same thing).
