I don't see anything that makes it unsafe.
1 might just be the way you are using it, hard to tell without seeing it
2 you are probably stuck with
3 you can always add a baggage door
I think you should learn to live with it or modify it as you wish. No point in beating your head into a wall and making yourself feel worse than you already do. If it doesn't have flaws and was built as designed they won't change it. Unfortunate you didn't notice these things before purchase.
