If you are parked there and you are allowed to be parked , what is the difference if you park and fall asleep ? I don't think NY state penal law has a 'Felony Snoozing' section .
Personally, I cant see any professional LEO ordering an overtired driver to operate a motor vehicle on a public highway. I think a supervisor would override that one.
Who says they would order you onto the road? They more likely would just write a (very expensive) ticket for you.
