People get so focused on trying to stop/protect/find the perfect solution to the worlds ills, they wave a magic wand around pinpointing the issue of the day. It's sad.
So based on your comment, hands free phone conversations should be banned. I suspect at that point, one would have a tough time differentiating between a phone conversation and one with a passenger, so what the heck, ban them all then.
I'm being pointed, but trying to get folks to see a bigger picture. Where do you draw the line, which includes things YOU do, in the interests of safety to the public? I think the OP's situation is extremely beneficial to us for reflective thinking and planning...but probably just more fun to call the idiot an idiot and think we're going to stop the behavior??
