Her phone records would clearly show that she was using her phone when the incident occurred, if she was. But then the one's who are supposed to enforce the law are the biggest abusers of it cause of the "pass" they get for being in law enforcement (used in the performance of the job)....funny how that works. I'm willing to bet that 90% of their phone use has nothing to do with the job.
The problem with that idea is that it’s not illegal to use your phone hands free. Records can’t show how the phone is being used. Judge the poor driving for what it is, regardless of the cause.
