I disagree with the cell phone witch hunt. Cell phones are not the problem. Distracted drivers are the problem!
I get upset when my ability to live my life responsibly is impinged by government regulations. Have I used a cell phone while driving? Rarely, yes. And only when traffic & circumstances allow for it. My primary responsibility is to operate the vehicle safely.
Distracted drivers go back the first AM radio installed in a car. Anyone remember messing with cassette tapes which wouldn't wind? Maybe scanning the FM dial trying to get a good reception? How about eating take-out while driving? And dare we look back to our youth with the very cute distraction in the passenger seat? :) Every one just as distracting as a cell phone.
Cell phones are the symptom. Irresponsible people using them are the problem. Putting a ban on the 'thing' doesn't suddenly make people responsible.
Unclear where the OP's accident occurred... California & Oregon already have no-cell phone laws. And that did nothing to stop the accident. I maintain that an irresponsible distracted driver was the root cause.
Sorry for the rant & contrarian view....
