We can be charged if the phone is laying on the console or seat within the driver's reach. Talk about overzealous enforcement.
I agree that cell phone use is a real hazard but let's bring some common sense into the mix.
Common sense and reality do not always agree. I recently saw a study that found how the mere presence of cell phones create a distraction for students and drivers. Also, a news channel did a segment on distracted driving, had the reporter driving in his car (while on camera), with a cell phone placed on the center console. People at the office texted him and, even though he was on camera, he commented how surprisingly difficult it was to not pick-up the device. Actually, there is a bunch of research on the topic and most results show the impairment is almost identical to DUI. Now, think about when they're combined!!
The distraction caused by cell phones doesn't just have to do with the hands and eyes, the real distraction is the limitation of our brains to perform multiple tasks at the same time. The fact is - we stink at it! The easiest place to witness the distraction, is by observing shoppers at the store while they're on the phone. Typically, they are oblivious to their surroundings. We probably all have stories of shoppers running into us with a shopping cart while they were chatting on a cell phone.
Do you really feel safe putting those same people behind the wheel? I do not!
