It is not the law that is in question with commercial registrations, but the execution. All those laws are like "100" years old but were not executed at all, till economy crisis after year 2000.
My 1999 F450 was originally registered at its empty 9000 lb weight and I never drove via scales with that flatbed.
It wasn't till 2008 when having big load on flatbed, I got pulled over by DOT officer who gave me fix it ticket to go to DMV.
There my registration was changed to commercial with addition of $450 weight fee.
So it all depends how much money state will need and we might see more and more DOT scale chasing.
