The guy pulling the trailer was hauling tail trying to get around the trucker. Period
Speed had as much to do with this accident as his tire brand. There is no proof that he had a tire failure, and there is no proof that his speed caused the wreck. By your own admission, he failed to clear the overtaken vehicle before merging back in front. Speed is irrelevant. I don't know why you don't understand that. You say the speed limit was 65. Even if he was doing 60 in a 65 (something I think you would agree is a "safe" speed) and he made that bone headed mistake, the results would likely have been the same. 55 instead of 65... results likely the same.
SPEED IS IRRELEVANT if he struck the semi and lost control, went down an embankment and flipped. I would be willing to bet that even at 45 mph, that is very likely a fatal collision for an older person.
Driver error, sure sounds like it.
Speed a factor... I haven't heard or seen one iota of truth to sustain that allegation.
By the way, that picture you posted seems to show it is a 2 lane highway, one lane each direction. Is that accurate? Did the pickup driver cross a double yellow line to die?
