I, for one, will state that if I were comfortable in taking a shot at someone, in this scenario, I wouldn't hesitate to do it. It easily meets the most important criteria: do you feel that your life is in danger.
However, in the event that it was not safe to do so, either for myself or other innocent people/property, then NO, I wouldn't do it.
We are armchair quarterbacks indeed. We don't know what was going on. He might have felt very comfortable and safe in that moment. Or, he might be a deranged old man that just doesn't give a flip ;)
