VW under rates their MPGs. By a lot. My TDI says 41 highway. I get 41 around town and have gotten 51 on the highway. My wife's TDI has gotten 55 mpg and is mid forties around town. We're both rated for 41 highway and 36 city. I had a loaner gas car they did 36 city.
Ford got caught over rating 6 of their cars by A LOT, especially the Cmax and the fed came down and landed on them.
the so-called underrating is indicative of the mileage you can expect once the pollution equipment is working. Then couple that with lost performance and you'll experience the car legally.
VW didn't underrate. They cheated.
