MPG rating is not done by the EPA. The EPA sets up the tests protocols and it's up the manufactures to conduct those tests. Ford acknowledged that some of their assumptions were off in their testing, like their rolling resistance input.
The EPA only tests if they receive a flood of complaints like they did about Hyundai and Kia who had to roll back 13 models and like Ford issue refunds for the false ratings.
So in essence the do get to "pick and choose" their ratings and hope not to get caught. But it's obvious that the car makers have been overzealous in choosing their MPG ratings.
