Ron, I guess that would be something for the lawyers to argue about in court. It does say "and" but it also lists them separately as "a" and "b" so who really knows the intent?
JIMNLIN, the very beginning of your quote says "under the Commercial Transport Act" which could mean it only pertains to commercial carriers and not personal vehicles. I don't know.
When I used to register and operate small commercial service trucks (Ohio) I did register them at a specific GVWR. However, I chose what number I gave them, it was not necessarily the same as the manufacturer's GVWR. Although the registered number was binding and legal it was really only for road use tax purposes.
