Ron, I guess that would be something for the lawyers to argue about in court. It does say "and" but it also lists them separately as "a" and "b" so who really knows the intent?
I think the intent is quite clear. If the intent is that either "a" or "b" could trigger the exemption, I think the word "or" would have been used instead of "and".
But I guess that depends on what the meaning of "is" is. :)
